Can a persons social security income be attached for nonpayment of a financial debt?

My mother-in-law is 93 years old and in failing health, she is in a full time care facility, she has an outstanding credit card debt of approx. $5000.00. She only has her social security for income and all but $35.00 a month of that goes to pay for her care.

Perhaps thihs question should be directed to her legal representative At 93 years young, in failing health, the financial insitution holding her credit card doesn%26#039;t look at her age when it comes to collecting. They see a debt owed, an amount due monthly and the fact that payment has not be made against it. They will attempt to do what they can to obtain the funds from her irregardless of her position.



A person in a legal capacity has a lot more influence than a family member has unfortunately. They are bound to act within the boundaries of the law whereas a family member can be viewed upon as someone simply trying to help someone else skip from a debt. Sad but true. However, that same legal rep can arrange a payment arrangement that is far more favorable than the one that may already be in place. Have the lawyer look at this prior to speaking with the SSA as he can stop any garnishing that could be in progress, from reaching that office.

It is against the law for any agency or person to collect monies from a SS beneficiary. Only SS has the power to dictate a change in payment. If SS overpays your grandmother she will know about it. I%26#039;ve been there before. Hope this helps. Report It

If a collection agency is getting money out of your check it%26#039;s because you%26#039;ve given it to them. Garnishment or otherwise is against the law. Keep in mind collection agencies. Will intimidate with accruing interest charges on a past due account. In that case... Let the accruing begin...LOL Report It
